Berg Files Amended Complain Against Obama

Berg expanded on some of his people he as accused of lack of due diligence and has expanded on his standing argument and added new facts according to his site. Again, please remember that this is not decided law yet. This is a filing, no more, no less. All it takes to make one is a postage stamp. But I think some of his arguments are fairly compelling, especially the argument that Barry forfeited his citizenship when he was adopted by his mother’s second husband in Indonesia and became an Indonesian citizen as a result.

Can a child “give up” their American citizenship?

That’s one of my problems with the “Indonesian angle”. Obama’s mother was an American citizen and Obama’s citizenship doesn’t just disappear once she remarries or if her husband adopts Obama.

They’re barking up the wrong tree with this. Though I admit enjoying the fury this has unleashed in the Obama campaign, it’s really a waste of resources when there are so many other problems with Obama that should be addressed.

Having waded through most of the brief, it is a bit better done than the earlier one. Berg still has his fact of law wrong on the 5 years after age xx but it does not really effect his claim, be it 14 or 16, his mother was still too young. An interesting insertion is the request for Certified copies of Obama’s Admission forms for Occidental College, Columbia University and Harvard Law School insofar as he has reason to believe 0bama listed himself as Kenyan. Also Berg is beating on him over the fact that: Obama further committed Fraud upon Plaintiff and the American people by falsifying information on his Illinois State Bar Registration and Public Disciplinary Record. Obama stated on his Application to the State Bar of Illinois, as proven by the Illinois State Bar Registration and Disciplinary Record, stating he never used any other names. Obama signed his application/registration for the Illinois State Bar under the penalty of perjury knowing the information to be false. The fact of the matter is Obama used the name Barry Soetoro in Indonesia and was registered as a citizen of Indonesia on his school records. Obama further used the name Barry Obama and it is further believed Obama used the name Barack and/or Barry Dunham. A minor point, but it is still perjury. Interestingly he states: Obama attempted to defraud Plaintiff and the American people by allowing an altered and forged Hawaii Certification of Live Birth (COLB) to be placed on his campaign website. Obama was well aware the Government issued COLB was altered and forged as the original document was in the name of Maya Kasandra Soetoro born in 1970. Maya Kassandra Soetoro’s Obama’s half sister who was born in Indonesia and her birth was later registered in Hawaii. The altered and forged COLB is still on my.barackobama.com If Hawaii is that lax about registering a birth that they would register a birth of somebody actually born in Indonesia, the birth certificate produced is worth squat, forged or not.

The answer to your question is yes, he can. He can perhaps reclaim it later as a naturalized citizen, but it has erased his “natural born status”. Founder’s intent on that was to prevent the President from having multiple national allegiances.

No. No natural-born citizen under the age of 18 may lose his or her citizenship without a specific, purposeful renouncement of citizenship under 8 U.S.C. 1481(a)(5). It may not be done accidentally or by a technicality (except by becoming an officer in a foreign army or an enlisted person in an army making war on the United States). Further, parents may not make a renouncement on behalf of a minor child. For a diplomatic or consular officer to accept a renouncement by a minor, he or she must meet the minor in person and become convinced that the renouncement is not under influence or duress and that the minor understands and accepts the consequences of the renouncement. And frankly, people who think they can are bad Americans. Citizenship to people born in the United States is guaranteed right in the US Constitution and the thought that some technicality can take it away from an unknowing child is abhorrent to the very idea of American citizenship. And yet people keep pursuing this like it’s something that should be taken seriously.

Berg is an anti-American nutjob who believes that 9-11 is an inside job, that the majority in Bush v. Gore should be disbarred and that President Bush is a war criminal.

Let me be more clear. You, Shr_Nfr, are being a bad American. You are doing no favors to the campaign to elect McCain (or Clinton or whoever you think you’re helping) and you should be shunned by all true Americans. Just stop.
